Cert. Filed In California Sea Scouts Case
The Pacific Legal Foundation has announced that on July 11 it filed a petition for certiorari (full text) to the U.S. Supreme Court in Evans v. City of Berkeley. The appeal is from a March 2006 decision of the California Supreme Court in which it upheld the right of Berkeley to suspend the Sea Scouts' (an affiliate of the Boy Scouts) free use of a berth in the city's marina after the scout group refused to confirm that it would not discriminate against gays or atheists.
