En Banc Review To Be Sought In O'Hare Case

The Arlington, IL Daily Herald reports that trustees from both Bensenville and Elk Grove Village, Illinois on Tuesday decided to seek an en banc rehearing in the DC Circuit in Village of Bensenville v. Federal Aviation Commission. Earlier this week, the cities lost a bid to block the expansion of O'Hare Airport in a challenge under the Religious Freedom Restoration Act to the moving of a cemetery as part of the airport expansion.
