Mojave Desert Cross Case Argued Before 9th Circuit
Last Monday, the U.S. Ninth Circuit Court of Appeals heard oral arguments in Buono v. Kempthorne, a case involving the constitutionality of a transfer of federal lands to private parties in order to preserve the Mojave Desert Cross war memorial. The cross was originally put up by the Veterans of Foreign Wars. When it was challenged in litigation, the federal government took steps to transfer the public land on which the cross sits to private ownership.
