RLUIPA Decision On Church Zoning Appealed By County To 10th Circuit
According to the Longmont Times-Call, the Boulder (CO) County Commission voted yesterday to direct the county attorney's office and its special counsel to file an appeal with the 10th Circuit in Rocky Mountain Christian Church v. Board of County Commissioners of Boulder County, Colorado. In the case, the Colorado federal district court found that there was sufficient evidence to support the jury's finding that the county violated the equal terms, substantial burden and unreasonable limitations provisions of the Religious Land Use and Institutionalized Persons Act in denying the church's special use application.
