New York High Court OK's State Employee Benefits To Same-Sex Spouses

In Godfrey v. Spano, (NY Ct. App., Nov. 19, 2009), New York's high court held that state civil service officials had authority to recognize, for purposes of employee health and other benefits, same-sex marriages validly performed in other states. The court pointed to the broad statutory authority given to the Civil Service Commission to determine who should obtain benefit coverage. Three concurring judges would have gone further and held that same-sex marriages, valid where performed, are entitled to full recognition under New York law.
