En Banc Rehearing Denied In Challenge To Inauguration Prayer and Oath
Yesterday the D.C. Circuit Court of Appeals denied a panel rehearing and also denied an en banc rehearing in Newdow v. Roberts. The case is an Establishment Clause challenge to prayer and use of "so help me God" in the oath at Presidential inauguration ceremonies. In May's panel decision dismissing the case, two judges held that it was moot and that plaintiffs lacked standing, while the third judge would have dismissed on the merits. (See prior posting.)
