Appeals Court Upholds Release of Psychiatric Files of Clergy In Sex Abuse Settlement
In Doe 1 v. Franciscan Friars of California, Inc., (CA App., Sept. 30, 2010), a California appellate court held that pursuant to a settlement in a clergy sex abuse case, various confidential files of six alleged perpetrators could be released to the public. The court found that "compelling social interests in protecting children from molestation outweigh the Individual Friars' privacy rights, and the trial court correctly ordered the public release of psychiatric and other confidential records in the possession of the Franciscans."
