Cert. Petition Filed In D.C.Refusal of Marriage Initiative

A petition for certiorari (full text) was filed in the U.S. Supreme Court yesterday seeking review of the D.C. Court of Appeals decision in Jackson v. District of Columbia Board of Elections and Ethics. In the case, D.C.'s highest appellate court, in a 5-4 decision, upheld election officials' refusal to accept a petition seeking an initiative vote to bar D.C. from recognizing same sex marriages. (See prior posting.) The petition asks the Supreme Court to decide whether the D.C. Council violated the Congressionally approved D.C.
