Court Says Factual Issues Remain As To Reasonable Accommodation of Sabbath Observance
In Maroko v. Werner Enterprises, Inc., (D MN, April 14, 2011), a Minnesota federal district court refused to grant summary judgment to a Seventh Day Adventist employee who was terminated from his position as a delivery truck driver because he refused to work on his Sabbath-- sundown Friday to sundown Saturday. In plaintiff's Title VII action, the court concluded that disputed factual issues exist as to whether the employer had offered plaintiff a reasonable accommodation.
