Massachusetts High Court Grants Direct Review In Pledge Case
The Massachusetts Supreme Judicial Court last week granted an application for direct appellate review of a trial court's decision in Doe v. Acton-Boxborough Regional School District, a case brought by an atheist-humanist family challenging the constitutionality of the daily recitation of the Pledge of Allegiance in Massachusetts schools. The trial court rejected a challenge under the Massachusetts state constitution to the practice, holding that insertion of the phrase "under God" was a reference to the historical and religious traditions of the United States and did not turn the Pledge into a religious exercise nor violate anti-discrimination requirements. No student is required to take part in the recitation, but plaintiffs argued that the recitation marginalizes them and classifies them as unpatriotic. (See prior posting).
