By a vote of 7-5 yesterday the U.S. 3rd Circuit Court of Appeals
denied an en banc rehearing in
Conestoga Wood Specialties Corp. v. Secretary of U.S. Department of Health and Human Services. In the case, a 3-judge panel in a 2-1 decision last month denied a preliminary injunction sought by a family-owned business to stop enforcement of the Affordable Care Act contraceptive coverage mandate. prior posting.) Alliance Defending Freedom announced that it would now petition the U.S. Supreme Court to review the decision.
