5th Circuit Rejects Discrimination Claim By Jehovah's Witness
In Norbach v. Woodland Village Nursing Center, Inc., (5th Cir., Augl 7, 2014), the U.S. 5th Circuit Court of Appeals, reversing the district court, dismissed a Title VII religious discrimination suit brought by a nursing home activities aide. Kelsey Nobach was fired by the nursing home after she refused to pray the Rosary with a patient. The court held that no evidence had been presented to the jury showing that the employer knew or reasonably should have known that her refusal was based on her Jehovah's Witness religious beliefs.
