Challenge To Florida School Choice Expansion Dismissed On Standing Grounds
In Faasse v. Scott, (FL Cir. Ct., Dec. 30, 2014), a Florida state trial court dismissed for lack of standing a suit by Florida teachers challenging a statute passed last year expanding private-school choice by creating Personal Learning Scholarship Accounts for special needs students and expanding the existing Florida Tax Credit Scholarship Program. Plaintiffs contended that SB 850 violates the state constitution's single subject requirement. The court held that plaintiffs failed to show that they suffered any special injury.
