In
American Justice Center (AJC), Inc. v. Modi, (SD NY, Jan. 14, 2015), a New York federal district court dismissed on immunity grounds a suit that was brought against the current prime minister of India over his actions as Chief Minister of Gujarat during
anti-Muslim rioting in 2002. The suit was brought under the
Torture Victim Protection Act and the
Alien Tort Statute. (See
prior posting.) The court accepted the U.S. government's contention that Modi enjoys immunity from suit as a sitting head of a foreign government.
