Yesterday, in a case that has implications for religious discrimination cases brought by the EEOC, the U.S. Supreme Court held that successful defendants in employment discrimination cases can recover attorneys' fees when they win on procedural grounds, as well as when they succeed on the merits. In
CRST Van Expedited, Inc. v. EEOC, (Sup. Ct., May 19, 2016), the court held that "a defendant need not obtain a favorable judgment on the merits in order to be a 'prevailing party.'"
