5th Circuit Hears Oral Arguments On School Board Invocations
The U.S. 5th Circuit Court of Appeals yesterday heard oral arguments (audio of arguments) in American Humanist Association v. Birdville Independent School District. Last August federal district court for the Northern District of Texas (full text of opinion) held that case law permitting legislative prayer applies to invocations at school board meetings. The practice of the Board, in its latest iteration, involved selecting students at random to make a presentation at each board meeting.
