Court Enjoins DOE Rule Favoring Funding of Private Schools Under CARES Act

In State of Washington v. DeVos, (WD WA, Aug. 21, 2020), a Washington federal district court granted a preliminary injunction barring enforcement of a Guidance and an Interim Final Rule issued under the CARES Act by the Department of Education. The rule essentially encourages use of a formula that has the effect of increasing the proportion of CARES Act funding going to private schools (including religious schools), at the expense of public schools.
