On Friday, the U.S. Supreme Court, by a vote of 6-3, denied review in the long-running case of Arlene's Flowers, Inc. v. Washington, (Docket No. 19-333, certiorari denied 7/2/2021). (Order List.) Justices Thomas, Alito and Gorsuch would have granted review. In the case, the Washington state Supreme Court held that a florist shop's refusal to provide flowers for a same-sex wedding constitutes sexual orientation discrimination under the Washington Law Against Discrimination, and that enforcement of the law does not violate the constitutional rights of the floral shop owner.
