Supreme Court Hears Arguments In Fair Housing Act Disparate-Impact Case
The U.S. Supreme Court heard oral arguments today in Texas Department of Housing and Community Affairs v. Inclusive Communities Project, Inc. At issue in the case is whether disparate-impact claims are cognizable under the Fair Housing Act, or whether there must be a showing of intentional discrimination. While this case involves claims of racially discriminatory impact, the Court's decision will apply to cases involving religious discrimination as well.
