DOJ, EEOC File Opposing Briefs On Title VII and LGBT Discrimination
On Wednesday, the Department of Justice filed an amicus brief (full text) with the U.S. Second Circuit Court of Appeals in the court's en banc rehearing in Zarda v. Altitude Express, Inc. In the case the Justice Department argued that "Title VII’s prohibition of sex discrimination does not encompass sexual orientation discrimination." That position directly contradicts the position taken by the EEOC in an amicus brief (full text) filed last month in the same case. The EEOC argued that sexual orientation discrimination claims "fall squarely within Title VII’s prohibition against discrimination on the basis of sex."
