Defendant Sentenced To 11 Years for Arson Attacks on Jehovah's Witness Kingdom Halls

Last Friday, a Washington federal district court sentenced 52-year-old Mikey Diamond Starrett to 11 years in prison followed by three years of supervised release for setting fire to three separate Jehovah's Witness Kingdom Halls and shooting into another Kingdom Hall. According to a Department of Justice press release, Starett pled guilty to four counts of violating the Church Arson Prevention Act and one count of using a firearm in relation to a crime of violence. The U.S. Attorney for the Western District of Washington said:

Starrett’s attacks irrevocably destroyed the sense of safety and peace that a house of worship is supposed to provide, and caused severe, permanent harm to the Jehovah’s Witness community in Washington. These were not crimes against buildings, but a series of attacks against a community and a faith.

18 Year Prison Sentence Imposed for Firebombing Church

The Department of Justice announced that on Monday an Ohio federal district court sentenced Aimenn D, Penny to 18 years in prison followed by 3 years of supervised release after Penny pleaded guilty to violation of the Church Arson Prevention Act and using fire and explosives to commit a felony. DOJ described the violations:

According to court documents, on March 25, 2023, Penny made Molotov cocktails and drove to the Community Church of Chesterland (CCC), in Chesterland, Ohio. Angered by the church’s plan to host two drag events the following weekend, Penny threw two Molotov cocktails at the church, hoping to burn it to the ground. Through Penny’s guilty plea, he admitted to using force through fire and explosives, intending to obstruct CCC congregants in their enjoyment and expression of their religious beliefs.

6th Circuit: Mosque Is Not In Interstate Commerce Under Federal Arson Statute

In United States v. Doggert, (6th Cir., Jan. 15, 2020), the U.S. 6th Circuit Court of Appeals reversed defendant's conviction for solicitation to commit federal arson of a local mosque. The federal arson statute (18 USC §844(i)) covers only property used in interstate of foreign commerce or in an activity affecting such commerce. The court said in part:
By any conventional measure, these terms do not cover the attempted destruction of a local mosque or for that matter any house of worship. In everyday English, one does not think of a mosque that serves a 200-person local community as a building used in commerce, much less interstate commerce. There may be plenty of good reasons to prosecute Robert Doggart for his deranged plan. But the words of this statute are not one of them.
However the court upheld Doggart's conviction under 18 USC §373 for solicitation to commit a crime of violence, namely destroying religious property in violation of 18 USC 247. [Thanks to Volokh Conspiracy for the lead.]

Ramadan Begins Tonight--Trump Issues Greetings

The Muslim holy month of Ramadan begins this evening.  President Donald Trump today released a statement (full text) wishing all Muslims a joyful Ramadan. He said in part:
During this month of fasting from dawn to dusk, many Muslims in America and around the world will find meaning and inspiration in acts of charity and meditation that strengthen our communities.  At its core, the spirit of Ramadan strengthens awareness of our shared obligation to reject violence, to pursue peace, and to give to those in need who are suffering from poverty or conflict.
This year, the holiday begins as the world mourns the innocent victims of barbaric terrorist attacks in the United Kingdom and Egypt, acts of depravity that are directly contrary to the spirit of Ramadan.  Such acts only steel our resolve to defeat the terrorists and their perverted ideology.
Also, reflecting an increase in anti-Muslim activity around the country, the organization Muslim Advocates issued an arson alert to mosques throughout the United Sates.

Arson Awareness Week Focuses On Arson Prevention At Houses of Worship

The U.S. Fire Administration has designated May 7-13, 2017 as National Arson Awareness Week, and has made the theme for this year "Arson Prevention at Houses of Worship."
