6th Circuit Grants En Banc Review Of Catholic School's Challenge To Mask Order

In Resurrection School v. Hertel, (6th Cir., Nov. 10, 2021), the U.S. 6th Circuit Court of Appeals vacated the 3-judge panel opinion and granted en banc review. The panel decision, by a 2-1 vote, upheld  Michigan's previous COVID-19 mask order for schools.  The court affirmed the denial of a preliminary injunction sought by a Catholic elementary school, concluding that the order was neutral and generally applicable.
