In Resurrection School v. Hertel, (6th Cir., Nov. 10, 2021), the U.S. 6th Circuit Court of Appeals vacated the 3-judge panel opinion and granted en banc review. The panel decision, by a 2-1 vote, upheld Michigan's previous COVID-19 mask order for schools. The court affirmed the denial of a preliminary injunction sought by a Catholic elementary school, concluding that the order was neutral and generally applicable. (See prior posting.)
