EEOC Suit Charging Failure to Accommodate Messianic Jewish Employee's Holidays Is Settled

The EEOC announced last week that Center One and Capital Management Services, two related companies, have settled a Title VII lawsuit that was brought by the EEOC and subsequently remanded for trial by the 3rd Circuit.  The suit charged failure to accommodate an employee's religious practices. The employee joined the case as a plaintiff.  According to the EEOC:

The EEOC’s lawsuit alleged that in October 2016, a Center One employee, an adherent of Messianic Judaism, requested a reasonable accommodation of his religious belief requiring abstaining from work on religious observance days.... Center One refused to grant the employee a schedule modification to observe religious holidays because he was unable to provide a certification from a religious leader or religious organization supporting his request. Instead, the company imposed disciplinary points against the employee..., even after being informed he was unable to obtain the requested certification because he was not a member of a congregation, thereby forcing the employee to resign....

The parties subsequently agreed to settle the case before trial, and on Oct. 24, the federal court approved the 18-month consent decree resolving the litigation. In addition to paying $60,000 to the employee, Center One and Capital Management Services are prohibited going forward from unlawfully denying reasonable accommodations for employees’ sincerely held religious beliefs, observances, and practices, and they are specifically barred from requiring that employees provide a certification from a religious leader, organization, or group as a general precondition for obtaining religious accommodation....

Messianic Jewish Missionaries May Proceed With Their Defamation Suit

In One for Israel v. Reuven,(SD FL, Sept. 26, 2022), a Florida federal district court in a defamation case held that Messianic Jewish missionaries are not necessarily "limited public figures" who must prove "actual malice" to succeed in a defamation suit. Refusing to dismiss the suit, the court held that the theological conflict between Judaism and Christian missionaries is not a public controversy. At issue in the case was a YouTube video in which defendant, an Orthodox Jewish rabbi, claimed that the missionaries beat up another rabbi at a meeting with an individual who was considering converting to Messianic Judaism. The court also rejected the claim that the ecclesiastical abstention doctrine requires dismissal of the suit. The court said in part:

The statements said in the video have nothing to do with religion; they were about a violent attack that did not happen. These issues have nothing to do with religious doctrine or conflict.

Israel's Supreme Court OK's Non-Profit Tax Status For Messianic Congregation

 All Israel News reports that a 3-judge panel of Israel's Supreme Court, sitting as the High Court of Justice, last week ordered the Knesset Finance Committee to grant non-profit status to a Messianic Jewish organization, Yachad, which operates a Messianic Jewish congregation.  Last year, the Finance Committee had rejected non-profit status for the organization. The court said in part:

The decision of the Finance Committee was based on an incorrect assumption, that they had the authority to take into consideration that a nonprofit is engaged in ‘controversial’ activity. Based on the tax authority’s examination, the organization’s missionary activity is not bound to illegal activity. The representatives of the Knesset also confirmed that the decision was value-based, that it is improper to finance a religious organization seeking to convert Jews, even if their activity is legal. … This confirms that the committee overreached in its authority.

EEOC Sues Over Denial of Religious Accommodation To Messianic Jewish Employee

The EEOC yesterday announced the filing of a lawsuit against Center One, LLC, a call center company:
According to the EEOC's lawsuit ..., a call center employee at Center One's Beaver Falls, Pa., location, who is an adherent of Messianic Judaism, sought a reasonable accommodation of his religious beliefs and practice that he abstain from work on days of religious observance.... Center One imposed disciplinary points against the Messianic Jewish employee for his absences in observance of Rosh Hashanah and Yom Kippur. Center One required that the employee provide a certification from a religious leader or religious organization "on letterhead" as a precondition of granting him time off as a reasonable accommodation and imposed disciplinary points against the Messianic Jewish employee for his absences in observance of those religious holidays...
