Trump Campaign Circumvents Nevada Church Limits By Holding Evangelical Rally At Casino

As previously reported, last month the U.S. Supreme Court refused to grant an injunction pending appeal to a Nevada church challenging the differential treatment of churches and casinos under the Governor's COVID-19 orders. Now according to Microsoft News:
President Trump's campaign is holding an "Evangelicals for Trump" event on Thursday at a Las Vegas hotel and casino, amid a controversial ban in the state on gatherings of more than 50 people in houses of worship while places like casinos are subject to a less stringent 50 percent capacity limit.
The event is scheduled to take place at ... one of the many joint hotels and casinos in Las Vegas. It will feature Trump spiritual adviser Pastor Paula White ... and others. The full event title is "Evangelicals for Trump: Praise, Prayer and Patriotism."
"In a time when many Nevadans can’t go to church because of overreaching restrictions, President Trump’s campaign is bringing together evangelicals from across the community to pray, worship and discuss key issues facing Americans in the November election," Trump 2020 deputy national press secretary Ken Farnaso said in a statement.

White House Praises Espinoza Decision

The White House press secretary yesterday issued the following statement (full text) on the Supreme Court's decision in Espinoza v.Montana Department of Revenue:
We celebrate today’s Supreme Court decision on religious schools, which removes one of the biggest obstacles to better educational opportunities for all children.  States may no longer hide behind rules motivated by insidious bias against Catholics, known as Blaine Amendments, to exclude religious schools from public benefits.  Laws that condition public benefits, like need-based academic scholarships, on religious status demonstrate state-sanctioned hostility to religion, pressure people and institutions to censor their religious views, and stigmatize disfavored religions.  The Trump Administration believes that school choice is a civil rights issue, and that no parent should be forced to send their child to a failing school.  President Donald J. Trump will fight for school choice, and he will always defend our first freedom: the free exercise of religion.

4th Circuit Dismisses "Muslim Ban" Lawsuits

In International Refugee Assistance Project v. Trump, (4th Cir., June 8, 2020), the U.S. 4th Circuit Court of Appeals dismissed three separate actions challenging President Trump's restrictions on the entry of foreign nationals from specified countries.  Among other things, plaintiffs contended that the Executive Order was "inexplicable by anything but animus toward Muslims." The Court of Appeals, relying on the U.S. Supreme Court's decision in Trump v. Hawaii, concluded:
At bottom, in view of the Supreme Court’s conclusions with respect to Proclamation 9645 in Hawaii, we conclude that the plaintiffs’ constitutional claims in this case lack the plausibility necessary to survive the government’s motion to dismiss under Rule 12(b)(6).

President Trump Issues Executive Order On International Religious Freedom

Yesterday, President Trump issued an Executive Order on Advancing International Religious Freedom (full text). The Order provides in part:
Within 180 days of the date of this order, the Secretary of State (Secretary) shall, in consultation with the Administrator of the United States Agency for International Development (USAID), develop a plan to prioritize international religious freedom in the planning and implementation of United States foreign policy and in the foreign assistance programs of the Department of State and USAID....
The Secretary and the Secretary of the Treasury shall ... develop recommendations to prioritize the appropriate use of economic tools to advance international religious freedom in countries of particular concern, countries on the Special Watch List, countries in which there are entities of particular concern, and any other countries that have engaged in or tolerated violations of religious freedom as noted in the report required by section 102(b) of the [Religious Freedom Act of 1998].

Presidential Message On Eid al-Fitr

Yesterday was Eid al-Fitr. On Saturday the White House posted a Presidential Message (full text) sending greetings to Muslims in the United States and around the world as they celebrated the feast. the message reads in part:
Over the past weeks and months, as we have fought the coronavirus, we have relied on our faith, family, and friends to help guide us through these unprecedented times.  As Muslims observe the day of Eid al-Fitr, we hope they find both comfort and strength in the healing powers of prayer and devotion.

Trump Presses For Reopening of Houses of Worship

In remarks today (full text) from the Blue Room balcony to ceremony honoring veterans and POW/ MIA's, President Trump said in part:
Today, I just spoke to CDC.  We want our churches and our places of faith and worship; we want them to open.  And CDC is going to be — I believe today they’re going to be issuing a very strong recommendation.  And I’m going to be talking about that in a little while.  But they’re going to be opening up very soon.  We want our churches open.  We want our places of faith, synagogues — we want them open.  And that’s going to start happening.  I consider them essential, and that’s one of the things we’re saying.  We’re going to make that essential.
You know, they have places “essential” that aren’t essential, and they open.  And yet the churches aren’t allowed to open and the synagogues and — again, places of faith — mosques, places of faith.  So that’s going to — see that — you’re going to see that.
Later, at a White House press conference, the President again spoke about reopening of houses of worship. CNBC reports on the press conference:
President Donald Trump on Friday demanded that governors reopen churches, synagogues and mosques “right now,” and threatened to “override” state leaders’ restrictions if they do not do so by the weekend....
Trump said it was an “injustice” that some state leaders have allowed “liquor stores and abortion clinics” to stay open amid the Covid-19 pandemic while closing houses of worship.
“It’s not right,” Trump said. “I’m calling houses of worship essential.”
“If there’s any question, they’re going to have to call me, but they’re not going to be successful in that call,” Trump said of state leaders.
“The governors need to do the right thing and allow these very important essential places of faith to open right now, for this weekend,” Trump said.
“If they don’t do it, I will override the governors.” ...
White House press secretary Kayleigh McEnany, when asked what authority allows Trump to override a governor’s rules, did not provide a specific provision.
Instead, she said “the president will strongly encourage every governor to allow their churches to reopen – and boy, it’s interesting to be in a room that desperately wants to seem to see these churches and houses of worship stay closed.”

Yesterday's National Day of Prayer Proclamation

Missed in the flood of developments, yesterday was National Day of Prayer. Here is the full text of President Trump's Proclamation which focused in large part on the COVID-19 crisis, saying in part:
Today, as much as ever, our prayerful tradition continues as our Nation combats the coronavirus.  During the past weeks and months, our heads have bowed at places outside of our typical houses of worship, whispering in silent solitude for God to renew our spirit and carry us through unforeseen and seemingly unbearable hardships.  Even though we have been unable to gather together in fellowship with our church families, we are still connected through prayer and the calming reassurance that God will lead us through life’s many valleys.  In the midst of these trying and unprecedented times, we are reminded that just as those before us turned to God in their darkest hours, so must we seek His wisdom, strength, and healing hand.  We pray that He comforts those who have lost loved ones, heals those who are sick, strengthens those on the front lines, and reassures all Americans that through trust in Him, we can overcome all obstacles....
I encourage all Americans to observe this day, reflecting on the blessings our Nation has received and the importance of prayer, with appropriate programs, ceremonies, and activities in their houses of worship, communities, and places of work, schools, and homes consistent with the White House’s “Guidelines for Opening up America Again.”

Trump On COVID-19 Restrictions On Worship Services

On Sunday, President Trump answered questions for nearly two hours at a Fox News Virtual Town Hall, televised from the Lincoln Memorial in Washington, D.C. (Transcript of full Town Hall.) Here is what the President had to say about state restrictions on in-person worship services:
VIEWER:  Hi, Mr. President.  My husband and I both work at our local church, and I think a lot of us churchgoers are just wondering when we might be able to get back to an in-person church service.  Do you have any idea when this might be?
THE PRESIDENT:  I hope it’s going to be very soon, because I’m seeing things that I don’t like seeing.  I see some churches — they are literally staying in their car with the window closed.  I guess it comes out through the radio, the service.  And they were getting arrested, and they’re sitting in a car, and the cars are even far away.  And they say, “Close your windows.”  So it has to come in electronically, and I’m saying, “Why can’t they do that?”
Or they’ll go in a field, some field, and they’ll be — they’ll have a good minister, pastor, or could be a rabbi, could be a person of faith, and what happens is, in some places — not in all places — I would say in most places they really sympathize.  But I do.
And I’ve been listening to services over the last four or five weeks.  Some very, very good people.  And everybody knows who I’ve been listening to.  And we go different person.  Last week it was Cardinal Dolan at St Patrick’s Cathedral, a place I’m very familiar with.  But we’ve had pastors and ministers.
I will say this: It’s wonderful to watch people over a laptop, but it’s not like being at a church.  And we have to get our people back to churches, and we’re going to start doing it soon.
Q    The Attorney General sent a memo directing U.S. attorneys to be on the lookout for health restrictions that could interfere with constitutional rights.  There are a lot of people who cheered that because, you know, they do want to go back to church, and as you’re talking about.  But there are others who fear he might be encouraging people to do things that might be unsafe at the time when some states are going up.
THE PRESIDENT:  Yeah.  No, he’s not — well, there’s not too many states that I know of that are going up.  Almost everybody is headed in the right direction....

Last week, President Trump issued a Proclamation (full text) declaring May 2020 as Jewish American Heritage Month. The Proclamation reads in part:
This month, we reaffirm our commitment to never compromise our steadfast support for the Jewish community, our rejection of anti-Semitic bigotry, and our disdain for malicious attacks of hatred.  Jewish Americans strengthen, sustain, and inspire our country through dedication to family, respect for cherished traditions, and commitment to the values of justice and equality that unite Americans of every faith and background.

President Trump Issues Message of Good Wishes As Ramadan Begins

The Muslim holy month of Ramadan began yesterday. President Trump issued a message (full text) wishing all Muslims in the U.S. and around the world a blessed and peaceful Ramadan. The message said in part:
Over the past months, we have seen how important the power of prayer can be during challenging times.  Today, as the holy month of Ramadan commences, I pray that those who are observing this sacred time find comfort and reassurance in their faith.

President Trump Sends Easter Greetings

The White House this morning posted President Trump's Presidential Message on Easter, 2020. It reads in part:
Melania and I join millions of Christians celebrating the resurrection of Jesus Christ and the gift of eternal life this Easter.  Although this year’s observance of Easter comes during a somber time for our Nation, we hope all of you are filled with the joy, love, and hope that marks this holiest of days.
As our Nation has faced the unique challenges posed by the coronavirus during the past few weeks, we have turned to God for guidance, comfort, and hope.  Throughout this difficult period, we have witnessed the core tenets of Christianity—love, compassion, and kindness—reflected in the many acts of courage, generosity, and caring of the American people.  Our country’s citizens have taken to heart the words of 1 Peter 4:10: “Each one should use whatever gift he has received to serve others, faithfully administering God’s grace in its various forms.”

President Calls For Day of Prayer For Protection and Strength

In a Tweet issued yesterday President Donald Trump said:
It is my great honor to declare Sunday March 15 as a National Day of Prayer. We are a Country that, throughout our history, looked to God for protection and strength in times like these. No matter where you may be, I encourage you to turn towards prayer in an act of faith. Together we will easily PREVAIL!
However, no formal Presidential Proclamation on the day of prayer appears on the White House website. Fox News reports on the President's statement.

Trump, Pence Speak At National Prayer Breakfast

Both Vice President Pence and President Trump spoke at the National Prayer Breakfast in Washington, D.C. yesterday. Pence (full text of remarks) said in part:
As the President has said many times, in his words, “We are a nation of faith.”  And I can assure you that this President, this Vice President, and our entire administration believe in prayer and we rely on the prayers of the American people every day.
In fact, President Trump has made it a practice of opening every Cabinet meeting in prayer.
President Trump spoke later in the morning (full text of remarks). This passage has probably captured the most press attention:
Weeks ago, and again yesterday, courageous Republican politicians and leaders had the wisdom, the fortitude, and strength to do what everyone knows was right.  I don’t like people who use their faith as justification for doing what they know is wrong.  Nor do I like people who say, “I pray for you,” when they know that that’s not so.

Trump Extends Some Travel Ban Restrictions To Six More Countries

In an exceptionally long Presidential Proclamation (full text), President Trump on Friday extended tailored restrictions under his controversial travel ban to immigrants (but not temporary visitors) from six additional countries. As explained by a News Release from the Department of Homeland Security:
.... For four countries – Burma, Eritrea, Kyrgyzstan, and Nigeria – the President has imposed travel restrictions on immigrant visas.
The reason is straightforward – individuals who have entered the U.S. on immigrant visas are challenging to remove even if, after admission into the U.S., the individual is linked to disqualifying information such as terrorist connections, criminal ties, or misrepresented information. 
 And because each of these countries have deficiencies in sharing terrorist, criminal or identity information, it is likely that information reflecting that a visa applicant is a threat may not be available at the time the visa or entry is approved. This is unacceptable.
 Two countries – Sudan and Tanzania – performed marginally better and the President decided to impose travel restrictions on Diversity Visas.  This is a less severe sanction compared to the general restriction on immigrant visas, given the significantly fewer number of aliens affected....
... [T]his Proclamation only restricts entry on certain categories of immigrant visas. Family members can still visit their loved ones, businesses can still employ qualified candidates, and other visits can take place on a temporary basis with a non-immigrant visa.

4th Circuit Hears Arguments In Challenge To Trump's Travel Ban

The U.S. 4th Circuit Court of Appeals yesterday heard oral arguments (audio of full oral arguments) in International Refugee Assistance Project v. Trump.  In the case, a Maryland federal district court refused to dismiss Establishment Clause, due process and equal protection challenges to President Trump's third travel ban Proclamation. (See prior posting.) The case had been remanded by the U.S. Supreme Court in light of its rejection of an Establishment Clause challenge in a parallel case. Brown County Democrat reports on the oral arguments.

Trump Releases Middle East Peace Plan Including Plans For Jerusalem and Holy Sites

President Trump today released his his 181-page Israeli- Palestinian peace plan titled Peace To Prosperity. (Full text of plan.) The briefer Fact Sheet released by the White House summarizes the plan's provisions on Holy Sites in Jerusalem:
Israel will continue to safeguard Jerusalem’s Holy Sites and will guarantee freedom of worship for Jews, Christians, Muslims, and people of all faiths.
  • The status quo at the Temple Mount/Haram al-Sharif will be preserved.
  • The special and historic role of the King of Jordan with regard to the Muslim Holy Shrines in Jerusalem will be preserved.
  • All Muslims are welcome to peacefully visit al-Aqsa Mosque.
The full plan includes this language as part of its description of arrangements for Jerusalem and its holy sites:
Unlike many previous powers that had ruled Jerusalem, and had destroyed the holy sites of other faiths, the State of Israel is to be commended for safeguarding the religious sites of all and maintaining a religious status quo.
Given this commendable record for more than half a century, as well as the extreme sensitivity regarding some of Jerusalem’s holy sites, we believe that this practice should remain, and that all of Jerusalem’s holy sites should be subject to the same governance regimes that exist today. In particular the status quo at the Temple Mount/Haram al-Sharif should continue uninterrupted.
Jerusalem’s holy sites should remain open and available for peaceful worshippers and tourists of all faiths. People of every faith should be permitted to pray on the Temple Mount/Haram al-Sharif, in a manner that is fully respectful to their religion, taking into account the times of each religion’s prayers and holidays, as well as other religious factors.....
... We believe that returning to a divided Jerusalem, and in particular having two separate security forces in one of the most sensitive areas on earth, would be a grave mistake.
While a physical division of the city must be avoided, a security barrier currently exists that does not follow the municipal boundary and that already separates Arab neighborhoods (i.e., Kafr Aqab, and the eastern part of Shuafat) in Jerusalem from the rest of the neighborhoods in the city.
This physical barrier should remain in place and should serve as a border between the capitals of the two parties.
Jerusalem will remain the sovereign capital of the State of Israel, and it should remain an undivided city. The sovereign capital of the State of Palestine should be in the section of East Jerusalem located in all areas east and north of the existing security barrier, including Kafr Aqab, the eastern part of Shuafat and Abu Dis, and could be named Al Quds or another name as determined by the State of Palestine. 

Presidential Message On International Holocaust Remembrance Day

Yesterday the White House issued a Presidential Message on International Holocaust Remembrance Day, 2020. (Full text). It says in part:
This year’s annual observance of International Holocaust Remembrance Day is especially moving as we commemorate the 75th anniversary of the liberation of Auschwitz....
Unfortunately, there are still Jewish men, women, and children who face persecution and discrimination today.  To fight the rise of anti-Semitism in the United States, I issued an Executive Order in December of 2019 that will help combat racist, anti-Semitic discrimination.  Anti-Semitism will never be tolerated, and this action bolsters my Administration’s efforts to create a culture of respect that deeply values the dignity in every human life.

President Proclaims National School Choice Week

Yesterday President Trump issued a Presidential Proclamation (full text) declaring January 26 to February 1 as National School Choice Week.  His Proclamation says in part:
Each child is a gift from God who has boundless potential and deserves a fair shot at the American Dream. To have that fair shot, children and their families must be free to pursue an educational environment that matches their individual learning style, develops their unique talents, and prepares them with the knowledge and character needed for fulfilling and productive lives.....
Today, I renew my call on the Congress to focus on what is best for children and pass a Federal tax credit to support State-based educational choice programs.....

Trump Addresses March For Life

Yesterday President Trump addressed the 47th Annual March for Life on the National Mall in Washington. (Full text of remarks). He is the first President to attend the March in person.  He said in part:
All of us here today understand an eternal truth: Every child is a precious and sacred gift from God.  (Applause.)  Together, we must protect, cherish, and defend the dignity and sanctity of every human life.  (Applause.)...
We have taken decisive action to protect the religious liberty –- so important.  Religious liberty has been under attack all over the world, and, frankly, very strongly attacked in our nation.  You see it better than anyone.  But we are stopping it, and we’re taking care of doctors, nurses, teachers, and groups like the Little Sisters of the Poor.  (Applause.)  We are preserving faith-based adoption.  (Applause.)
And to uphold our founding documents, we have confirmed 187 federal judges — (applause) — who apply the Constitution as written, including two phenomenal Supreme Court Justices: Neil Gorsuch and Brett Kavanaugh.  (Applause.)
