EEOC Sues Over Firing of Muslim Employee

The EEOC announced this week that it has filed a Title VII religious discrimination lawsuit against KASCO, a St. Louis-based company that manufactures and sells butcher supplies and meat processing equipment. The press release explains:

According to EEOC's lawsuit, Latifa Sidiqi had worked for KASCO since 2008, most recently as a buyer. After she began more seriously practicing her religion in 2012, a supervisor and others began making derogatory comments about her fasting during Ramadan, wearing a hijab, and her native country, Afghanistan. The agency charged that Sidiqi was fired during Ramadan 2013 because of her religion and national origin, and because she complained about her supervisor's treatment.

Canadian Court Finds Human Rights Act Violation In School's Denying Prayer Space To Muslim Students

In Webber Academy Foundation v Alberta (Human Rights Commission), (AB QB, Aug. 10, 2016), a Canadian trial court in the province of Alberta upheld a decision of the Alberta Human Rights Commission finding that a private school violated the Alberta Human Rights Act by refusing to allow Muslim students a place for their daily prayers. The school argued that it is non-denominational and no kinds of religious activities are to be carried out on campus. Affirming the Human Rights Commission's $26,000 damage award, the court said in part:

Webber Academy, to its credit, adopted a public policy of welcoming young people of many faiths and cultures, and to exemplify its policy, published photographs of students with turbans and facial hair even though these practices contravened usual school policies.

For some reason, it drew the line at Sunni prayer rituals, conducted in private, in a place that was convenient to the school and the students from time to time. Its policy thus discriminated against the belief of the complainant Sunni Muslim students as compared, for example, to students who overtly averred their religious affiliation by forms of dress and grooming. There was no demonstrated hardship, let alone undue hardship, motivating this policy.

French Mayor Bans Muslim Burkinis On Beach [UPDATED]

In an order issued on July 28, but first publicized last week, the mayor of the seaside French city of Cannes has banned swimwear that does not reflect "good morals and secularism."  The order, which is effective through August, is aimed at preventing Muslim women from wearing burkinis-- full-body swimsuits.  According to NBC News, the mayor said that after last month's terrorist attack in nearby Nice killing 80 people and the subsequent attack on a church:

Beachwear manifesting religious affiliation in an ostentatious way, while France and its religious sites are currently the target of terrorist attacks, could create the risk of disturbances to public order.

UPDATE: Qantara reports that  an Aug. 13 court decision upheld the Cannes ban:

Three women backed by the Collective Against Islamophobia in France (CCIF) challenged the Cannes decision.... But a court in Nice rejected the request, saying the move was legal under French law forbidding people from "invoking their religious beliefs to skirt common rules regulating relations between public authorities and private individuals".

Meanwhile the resort of Villeneuve-Loubet imposed a similar ban.

Muslim Woman Sues Chicago Police Charging Profiling and False Arrest

Chicago Tribune reports on a federal civil rights lawsuit filed yesterday against the city of Chicago and 6 of its police officers by a Muslim immigrant from Saudi Arabia who says she was assaulted and wrongly arrested by police officers who profiled her as a possible suicide bomber, apparently in part because she was wearing a hijab and niqab. Her suit alleges use of excessive force, false arrest, unlawful search, malicious prosecution and violation of Al-Matar's right to freedom of religious expression.  The arrest took place on July 4, as Al-Matar was walking to catch a train home to break the Ramadan fast.

Muslim Flight Attendant Sues Over Refusal To Accommodate Objection To Serving Alcohol

CAIR Michigan announced yesterday that it has filed suit in federal district court against ExpressJet Airlines on behalf of a Muslim flight attendant who has religious objections to serving alcohol to passengers. Originally the flight attendant, Charee Stanley, had worked out arrangements with other flight attendants  on duty for them to serve all alcohol.  However apparently one of the flight attendants objected and the airline placed Stanley on administrative leave. The lawsuit follows an earlier complaint filed with the EEOC. (See prior posting.)

Texas Muslim Teen-- Alarm Clock Inventor-- Sues For Discrimination

As reported by the Dallas Observer, a lawsuit was filed yesterday in a Texas federal district court by teenager Ahmed Mohamed who made news last September when his Irving, Texas school teacher mistook an alarm clock Mohamed had constructed for a bomb. Police were called in and both an arrest and school discipline followed. As summarized by plaintiffs' lawyer:

Despite the fact that (the Irving police) knew it wasn't a bomb, that he never threatened anyone, never alarmed anyone, they yanked him out of his chair, put him in handcuffs and arrested him. There was no cause for arrest. Even after the police acknowledged it didn't look like a bomb, the school suspended him. So yes, those are violations of his civil rights.

The complaint (full text) in Mohamed v. Irving Independent School District, (ND TX, file 8/8/2016), asking for damages and an injunction, alleges in part:

The IISD has a long and ugly history of race struggles up to and including the Board of Trustees. Additionally, the State of Texas, including the IISD, has a history of discrimination against Muslims in Texas curriculum and schools. 

Colorado Rules Cargill's Somali Muslim Employees Are Entitled To Unemployment Compensation

Denver Post reported Thursday that Colorado's labor department has ruled that more than 100 Muslim employees fired in December from a Cargill, Inc. meatpacking plant are entitled to unemployment compensation.  At issue was whether the employees could take prayer breaks during their shifts. Cargill withdrew its appeals in the cases after losing in 20 of them.  The dispute in part reflects tensions between Somali workers and Hispanic workers who lead the Teamsters union that represents them.  It is estimated that the unemployment payments will cost Colorado's unemployment insurance fund nearly $1 million.

French Mayor Will Ban Women's Swim Because of Required Modest Dress

In France, the mayor of Pennes-Mirabeau-- a town near Marseille with a large Muslim population-- says he will ban a swim day for women planned at a local park for next month.  According to an AP report yesterday, the event is planned by the socio-cultural group Smile 13.  Women swimming at the event will be required to be covered from knee to chest (awra) in accordance with Muslim notions of modesty.  Mayor Michel Amiel says the decision to call for women to swim covered up is a "provocative act" and risks disturbing the public order after the recent terrorist attacks in Nice and at a Normandy church. USCIRF Criticizes China's Restrictions On Muslims During Ramadan

The U.S. Commission on International Religious Freedom yesterday issued a statement (full text) strongly criticizing restrictions imposed by the Chinese government on religious practices during Ramadan, ending with Eid al-Fitr. USCIRF Chair Thomas Reese, S.J. said:

The Chinese government once again has banned government employees, students, and children from fasting, and in some cases praying, during Ramadan.  While restrictions on Uighur Muslims’ religious practices take place year round, they are particularly onerous during Ramadan, giving lie to the government’s claim that Uighur Muslims in Xinjiang enjoy religious freedom.  They do not.  The Chinese government is violating its own constitution and international human rights standards by denying religious freedom to its citizens.

Obama Sends Eid al-Fitr Greetings

President Obama yesterday issued a statement (full text) sending greetings to the Muslim community on the arrival of Eid al-Fitr-- the holiday that marks the end of the month of Ramadan.  The President said in part:

Muslim Americans are as diverse as our nation itself—black, white, Latino, Asian, and Arab. Eid celebrations around the country remind us of our proud history as a nation built by people of all backgrounds; our history of religious freedom and civil liberties, and our history of innovation and strength. These legacies would not be possible without the contributions of Muslim Americans that make our country even stronger.

This past month, our country and the world endured challenges and senseless violence that broke our hearts and tried our souls.  Our prayers are with the hundreds of innocent lives, many of them Muslim, taken during the month of Ramadan in places like Orlando, Istanbul, Dhaka, Baghdad, and Medina. 

Here at home, we’ve also seen a rise in attacks against Muslim Americans. No one should ever feel afraid or unsafe in their place of worship. Many Americans have shared in the experience of Ramadan by volunteering in community service efforts to assist those in need and even fasting a few days with their fellow Muslim American co-workers. In the face of hate, it’s our American values and strength that bring us together to stand in solidarity and protect one another—thereby, making our Nation stronger and safer.

Muslim Americans have been part of our American family since its founding. This Eid, we recommit to protecting Muslim Americans against bigotry and xenophobia, while celebrating the contributions of Muslim Americans around the country, including one of our finest, the People’s Champion Muhammad Ali, to whom we bade farewell this Ramadan. Later this month, Michelle and I will host an Eid celebration at the White House and we look forward to welcoming Americans from around the country to celebrate the holiday.

India's Supreme Court May Consider Constitutionality of Muslim Divorce Practices

India's Supreme Court today said it will examine whether it has jurisdiction to invalidate Muslim personal laws if they interfere with constitutional rights.  According to NDTV, the move comes in a suit challenging triple talaq, the practice that allows a Muslim husband to divorce his wife by pronouncing three times the phrase "I divorce you." (Background.) One of the cases raising the question was brought by a woman whose husband divorced her through triple talaq delivered by mail. The court will hear arguments on the issue on Sept. 6.

Muslim NYPD Officer Wins Temporary Relief Over Beard Length

Once again (see prior posting) the New York City Police Department's grooming rules are being challenged in court.  According to yesterday's New York Daily News, the NYPD on Tuesday imposed a 30-day suspension without pay on a Muslim officer who works as a law clerk for the Department. The officer, Masood Sayed, refused to shave his one-inch long beard. The NYPD had previously allowed him to wear a beard one millimeter in length, but said a longer beard would create problems with proper sealing of department-issued gas masks.  A federal district court yesterday, finding a likelihood of success by Sayed, barred the NYPD from taking further disciplinary action against him until a July 8 hearing.

Donald Trump On Profiling of Muslims

Yesterday in a phone interview with program host John Dickerson on CBS's Face the Nation, presumptive Republican nominee Donald Trump spoke about the possibility of profiling Muslims in the wake of the attack in Orlando on a gay nightclub. Here is an excerpt from the full transcript:

DICKERSON: When you talk about political correctness, should a Muslim buying ammunition and weapons get extra scrutiny?

TRUMP: I don't know about that.

I think, right now, we have some pretty big problems. And there are problems coming out of radical Islamic -- the radical Islamic groups. You have a very, very strong group of people that is radical Islamic, and that seems to be a problem.

DICKERSON: And you said you would check respectfully the mosques. How do you respectfully check a mosque?

TRUMP: Well, you do as they used to do in New York, prior to this mayor dismantling.

By the way, if you go to France right now, they're doing it in France. In fact, in some instances, they are closing down mosques. People don't want to talk about it. People aren't talking about it. But look at what they're doing in France. They are actually closing down mosques.

DICKERSON: Can I ask you just a bottom-line question before we move on? You like to speak plainly. In December, we talked, and you said there possibly should be profiling. Just as a bottom line here, are you talking about increasing profiling of Muslims in America?

TRUMP: Well, I think profiling is something that we're going to have to start thinking about as a country. And other countries do it.

And you look at Israel and you look at others, and they do it. And they do it successfully. And I hate the concept of profiling. But we have to start using common sense, and we have to use -- we have to use our heads.

I see people that -- and I have seen it recently. We had a case where very much in my case, where we had -- we had tremendous numbers of people coming into a speech I was making. And people that obviously had no guns, had no weapons, had no anything, and they were being -- they were going through screening.

And they were going through the same -- the same scrutiny, the absolute same scrutiny as somebody else that looked like it could have been a possible person. So, we really have to look at profiling. We have to look at it seriously.

And other countries do it. And it's not the worst thing to do. I hate the concept of profiling, but we have to use common sense. We're not using common sense.

Indian Court Sentences 24 For Roles In 2002 Gujarat Religious Riots

On Friday, a court in India imposed sentences on the 24 defendants who were convicted earlier this month in the 2002 killings of 69 Muslims during religious riots in Gujarat state. AFP reports that eleven of the Hindu defendants were sentenced to life in prison for their part in the massacre at the Gulbarg Society housing complex.  The court sentenced twelve others to seven years in jail, and the remaining defendant to ten years for rioting and arson.

Postal Service Issues Eid Postage Stamp

On June 10, the U.S. Postal Service announced the issuance of a new Eid Greetings Forever Stamp, recognizing the Muslim festivals of Eid al-Fitr and Eid al-Adha. The ceremony releasing the postage stamp was held at the Islamic Center of America in Dearborn, Michigan.  A second special ceremony was held on June 13 at the Muhammad Ali Center in Louisville, KY. Obama Counters Trump's Statements On Muslims

President Obama, speaking in Washington yesterday after a meeting with his National Security Council (full text of remarks) responded to claims by Republican presumptive nominee Donald Trump that the President should be using the term "radical Islam" to refer to terrorists, and more broadly to some of Trump's proposals relating to Muslim immigrants:

So there’s no magic to the phrase “radical Islam.”  It’s a political talking point; it's not a strategy.  And the reason I am careful about how I describe this threat has nothing to do with political correctness and everything to do with actually defeating extremism.  Groups like ISIL and al Qaeda want to make this war a war between Islam and America, or between Islam and the West.  They want to claim that they are the true leaders of over a billion Muslims around the world who reject their crazy notions.  They want us to validate them by implying that they speak for those billion-plus people; that they speak for Islam.  That’s their propaganda.  That's how they recruit.  And if we fall into the trap of painting all Muslims with a broad brush and imply that we are at war with an entire religion -- then we’re doing the terrorists' work for them....

... We now have proposals from the presumptive Republican nominee for President of the United States to bar all Muslims from emigrating to America.  We hear language that singles out immigrants and suggests that entire religious communities are complicit in violence.  Where does this stop?... 

Are we going to start treating all Muslim Americans differently?  Are we going to start subjecting them to special surveillance?  Are we going to start discriminating against them because of their faith?  We’ve heard these suggestions during the course of this campaign.  Do Republican officials actually agree with this?  Because that's not the America we want.  It doesn't reflect our democratic ideals.  It won’t make us more safe; it will make us less safe -- fueling ISIL’s notion that the West hates Muslims, making young Muslims in this country and around the world feel like no matter what they do, they're going to be under suspicion and under attack.  It makes Muslim Americans feel like they're government is betraying them.  It betrays the very values America stands for.

We've gone through moments in our history before when we acted out of fear -- and we came to regret it.  We've seen our government mistreat our fellow citizens.  And it has been a shameful part of our history.

Trump Reacts To Orlando Attack In Speech Focusing On Immigration

Yesterday Republican presumptive Presidential nominee Donald Trump delivered a controversial speech (full text) in reaction to the June 12 killing of 49 people at a night club in Orlando, Florida. Focusing on immigration, Trump said in part:

We cannot continue to allow thousands upon thousands of people to pour into our country, many of whom have the same thought process as this savage killer.

Many of the principles of Radical Islam are incompatible with Western values and institutions.

Radical Islam is anti-woman, anti-gay and anti-American.

I refuse to allow America to become a place where gay people, Christian people, and Jewish people, are the targets of persecution and intimidation by Radical Islamic preachers of hate and violence.

Without distinguishing between mainstream Muslims and Islamist terrorists, Mr. Trump suggested that all Muslim immigrants posed potential threats to America’s security and called for a ban on migrants from any part of the world with “a proven history of terrorism” against the United States or its allies. He also insinuated that American Muslims were all but complicit in acts of domestic terrorism for failing to report attacks in advance, asserting without evidence that they had warnings of shootings like the one in Orlando.

Mr. Trump’s speech, delivered at St. Anselm College in Manchester, N.H., represented an extraordinary break from the longstanding rhetorical norms of American presidential nominees. But if his language more closely resembled a European nationalist’s than a mainstream Republican’s, he was wagering that voters are stirred more by their fears of Islamic terrorism than any concerns they may have about his flouting traditions of tolerance and respect for religious diversity.

Indian Court Convicts 24 In Killing of Muslims In 2002 Gujarat Riots

Al Jazeera reports that a court in India yesterday convicted 24 people in the 2002 killings of 69 Muslims during religious riots in Gujarat state.  36 others were acquitted for lack of evidence.  The killings took place when a Hindu mob stormed a cluster of buildings in Ajmedabad where Muslims were hiding.  The mob burned and hacked the victims to death.

Muslim Prof Says Administrators Discriminated In Favor of Nigerian Christians

The New Orleans Times-Picayne reports that on Tuesday a Muslim biology professor at Southern University in New Orleans sued in federal district court claiming that administrators discriminated against him and other Muslim professors in order to get rid of them and hire Nigerian Christians, favored by the school's Chancellor Victor Ukpolo. Plaintiff Ibrahim Ekaidi contends that administrators encouraged non-Nigerian faculty to leave by denying them committee assignments, pay raises promotion and tenure.

Tajikistan Voters Ban Religious Political Parties

Deutsche Welle reports that voters in Tajikistan yesterday overwhelmingly (94.5% in favor) approved a series of constitutional amendments. One of them bans all political parties based on religion.  Last year the government labeled the opposition Islamic Renaissance Party of Tajikistan (IRPT) a terrorist group and a court shut it down.  According to The Guardian, before then the IRPT had been viewed as moderate and was President Emomali Rakhmon's chief opposition. In another amendment approved by voters yesterday, 63-year-old President Rakhmon is now allowed to run for an unlimited number of terms.  The lifting of the term limit ban applies only to him.
