Suit was filed last week in a New York federal district court challenging an upstate New York town's refusal to permit placing of a privately-sponsored nativity display in the town square during the Christmas season. The complaint (full text) in Polverino v. Town of Brighton, New York, (WD NY, filed 7/21/2026), alleges that the town every year permits a Menorah display sponsored by Chabad Lubavitch, while Brighton town officials have ignored, evaded and effectively denied plaintiff's Nativity display requests for more than two years. Plaintiff alleges that this violates his free speech and free exercise rights, as well as the 1st Amendment's Establishment Clause and the 14th Amendment's Equal Protection clause.
