Muslim Call to Prayer Can Be Amplified In New York City

Yesterday, New York City Mayor Eric Adams announced a new initiative to permit mosques to broadcast the call to public prayer on Fridays and during Ramadan. According the announcement from the Mayor's office:

 “Today, we are cutting red tape and saying clearly that mosques and houses of worship are free to amplify their call to prayer on Fridays and during Ramadan without a permit necessary....

... The NYPD’s new legal guidance clarifies for mosques and masjids that the call to prayer is allowed in New York City and not prohibited despite sound restrictions in city neighborhoods.

Under the new guidance, a mosque or masjid can broadcast the call to prayer every Friday between 12:30 PM and 1:30 PM as well as during the sunset prayers every evening during Ramadan....

The NYPD Community Affairs Bureau and Muslim faith leaders will work collaboratively in every neighborhood with mosques and masjids to communicate the new plans for Adhan to local community leaders and stakeholders. They will work to ensure that any sound device used to broadcast an Adhan is set at appropriate decibel levels and in accordance with the rules of the noise code within the city’s administrative code.

In 9th Circuit Church Loses Suit Against Loud Music Festival

In Amistad Christiana Church v. Life Is Beautiful, LLC, (9th Cir., July 3, 2017), the U.S. 9th Circuit Court of Appeals rejected a claim by a Christian church that a music festival put on by Life is Beautiful, LLC with a permit from the City of Las Vegas was so intrusive that it violated their free exercise and free speech rights.  The court found no state action, concluding that Life is Beautiful is a private entity not acting under color of state law.  The city's special event permit regulated permissible sound levels for the festival.  And the city is immune from civil liability for suits based on the exercise of its discretionary functions.

In Israel, Anti-Noise Bill Aimed At Mosques Falters When Legislators Realize It Also Bars Jewish Sabbath Alerts

The Washington Post reported yesterday that in Israel this week, ultra-Orthodox Jewish government ministers stopped progress in the Knesset (Parliament) on a government-approved bill that would have prevented religious institutions from using loud speakers.  The law was aimed at mosques in which the five-times-per-day calls to prayer are broadcast through loudspeakers attached to the top of minarets.  Jewish Israelis living close to Muslim neighborhoods have complained for years, especially about the early morning calls to prayer that wake them. Arab Israelis had strongly opposed the law, one Arab Knesset member calling it "a populist and racist attempt to incite against the Arab public."  What stopped the bill however was the realization by Orthodox Jewish Knesset members that the bill, written in broad terms, would also outlaw sirens used in Jewish neighborhoods to alert Jews to the start of the Sabbath.
