UN Human Rights Council Adopts Resolution Condemning Burning of Qur'an

The United Nations Press Centre reports that on July 14, the United Nations Human Rights Council

concluded its fifty-third regular session after adopting 30 resolutions and holding an urgent debate on the alarming rise in premeditated and public acts of religious hatred as manifested by recurrent desecration of the Holy Quran in some European and other countries.

The Council adopted Resolution A/HRC/53/L.23, Countering Religious Hatred Constituting Incitement to Discrimination, Hostility or Violence (full text), which reads in part:

Affirming that burning the Holy Qur’an or any other holy book is offensive, disrespectful and a clear act of provocation, constituting incitement to discrimination, hostility or violence and a violation of international human rights law, ...

Condemning any advocacy of religious hatred that constitutes incitement to discrimination, hostility or violence, whether it involves the use of print, audiovisual or electronic media or any other means...

1. Condemns and strongly rejects the recent public and premeditated acts of desecration of the Holy Qur’an, and underscores the need for holding the perpetrators of these acts of religious hatred to account in line with obligations of States arising from international human rights law....

Russian Opposition Leader Navalny Sues Prison Officials To Obtain A Quran

According to reports from AP and The Hill, imprisoned Russian opposition leader Alexei Navalny is suing prison officials to obtain access to volumes of the Quran with commentary that he purchased. AP says in part:

Navalny has faced criticism over the years for using nationalist rhetoric regarding migrants, many of whom arrive in Russia from predominantly Muslim nations in Central Asia.

He said Tuesday he had realized his “development as a Christian requires studying the Quran,” adding that he decided to become “the Quran champion among Russian non-Muslim politicians.”

Prison authorities say that they must screen all books for extremism before making them available to prisoners, and that this will take three months. Navalny is in the midst of a hunger strike and prison officials are threatening to force feed him. 

Suit Seeking U.S. Edit of Qur'an Dismissed As Frivolous

In Levay v. United States, (ED MI, July 11, 2017), a Michigan federal district court, adopting a magistrate's recommendation (LEXIS link), dismissed as frivolous a suit by a Jewish plaintiff  seeking a formal declaration that "Koranic Sharia Law" is incompatible with U.S. constitutional law. The suit also asks for the court to direct Congress to outlaw certain passages from the Qur'an, to issues a federally approved and edited version of the Qur'an, to withdraw tax exempt status from mosques that do not adopt this new version, and to establish a National Islamic Registry Program. The court said in part:

Levay’s suit seeks relief for the threat of violence that Islamic extremism poses to him and his community. But he does not allege injury to him personally, or an imminent, particularized threat of future injury.... Even if Levay did allege an actionable injury, the Court does not have the authority to direct Congress to legislate on an issue, much less vanquish the specter of religiously-motivated violence.... And, more fundamentally, Levay’s requests for a state-issued Koran, a national registry of Muslims, and financial sanctions for rogue mosques offend basic constitutional principles..... Levay does not have standing to bring suit and requests remedies which violate the Constitution.

UPDATE: In Levay v. United States, 2017 U.S. Dist. LEXIS 130138 (ED MI, Aug. 16, 2017), the court denied a motion by the plaintiff to amend the judgment.

Pakistan Sentences 5 To Death In Killing of Christian Couple Over Supposed Qur'an Burning

Last Wednesday a judge on Pakistan's Anti-Terrorism Court imposed the death sentence on five Muslims for torturing and killing a Christian couple who, it was alleged, had burned pages from the Qur'an in the brick kiln where they worked. Eight others were sentenced to two years in prison. Morning Star News, reporting on the sentences, recounts:

Hundreds of villagers in Kot Radha Kishan, incited by Muslim leaders calling for violence via mosque loudspeakers, were involved in the Nov. 4, 2014 assault in which 26-year-old Shahzad Masih and his five-months pregnant wife, Shama, 24, were thrown into a burning brick kiln....

Masih and his wife worked as bonded laborers at the brick kiln when the throng descended on them after area Muslims accused them of committing blasphemy by burning Quranic pages....

On Nov. 2, 2014 Shama Masih was cleaning her quarters ... when she found amulets of her late father-in-law, who had used them in the practice of black magic. The amulets may have contained koranic verses, and a Muslim co-worker, Muhammad Irfan, noticed half-burnt papers and accused the family of desecrating the Koran, relatives said.

NYC Municipal Judge Sworn In On Qur'an

Geo TV and ABNA report that last Thursday in New York City, a Muslim woman, Carolyn Walker-Diallo, was sworn in as a civil court judge of the 7th Municipal District in Brooklyn, using a Qur'an instead of a Bible for the ceremony.  Walker-Diallo who has been active in local politics and community development, wore a headscarf during the ceremony. Coming at a time of heightened anti-Muslim rhetoric from some quarters in the U.S., social media reaction to the swearing-in was mixed.

Afgahn Court Sentences Men Charged In Mob Killing Of Woman Falsely Accused of Burning Quran

Yesterday Afghanistan's Primary Court in Kabul sentenced four men to death by hanging for the mob killing of a 27-year old woman who was falsely accused of burning the Qur'an.  Eight others were sentenced to 16 years in prison, while charges were dropped against 18 men for lack of evidence.  Nineteen police officers charged in the case with neglect of duty and failure to stop the attacks will be sentenced on Saturday. AP reports:

On March 19, a mob attacked Farkhunda after an amulet peddler accused her of burning a Quran after she challenged him over selling his wares to women desperate to have children. Chilling mobile phone videos recorded the horror of the last moments of Farkhunda's life, as she was punched, kicked, beaten with wooden planks, thrown off a roof, run over by a car and ultimately set afire on the banks of Kabul River.

The two full days of hearings in Farkhunda's trial were broadcast live across the country.

Court Says Muslim Witness Cannot Take Oath On Quran

Today's Legal Intelligencer reports on a decision by a Pennsylvania trial court judge holding that a Muslim woman could not take her oath as a witness using the Quran. In Musaitef v. Musaitef, (Philadelphia County, PA Common Pleas), the court read 42 PA.C.S. Sec. 5901 strictly to require that the witness either take the oath on the Christian Bible or else make a non-religious affirmation. The case, a custody dispute between a Muslim mother and Muslim father, is still ongoing.  The father, who took his oath on the Bible, raised the objection to the mother using the Quran.  Apparently the mother's insistence on a Quran was intended to suggest that the father's testimony was untruthful because his Islamic faith included the belief that oaths taken on non-Muslim religious books do not bind him to tell the truth.

Russian Appeals Court Says Qur'an Translation Is Not Extremist Publication

RAPSI reported yesterday that in Russia, the Krasnodar Territorial Court has reversed the controversial ruling by the Novorossiisk District Court that had banned an abridged Russian translation of the Qur'an by Azerbaijani philosopher Elmir Kuliyev.  The lower court had held that the translation should be banned under the federal law barring extremist materials, and that copies of it should be destroyed. (See prior posting.) The Territorial Court has refused to declare the translation an extremist work.
