Good News Clubs Sue for Access to Hawaii Schools

Suit was filed two weeks ago in a Hawaii federal district court against the Hawaii Department of Education and four school districts in which schools have denied permission for Good News Clubs to use various school facilities for after-school programs. The complaint (full text) in Child Evangelism Fellowship of Hawaii, Inc. v. Hawaii State Department of Education, (D HI, filed 1/23/2024), alleges that the denials violate plaintiff's free speech, free exercise, Establishment Clause and equal protection rights. Plaintiff has also filed a Motion for Preliminary Injunction accompanied by a Memorandum of Law supporting the Motion (full text). Good News Clubs Sue to Get Access for After School Programs

Suit was filed last week in a Rhode Island federal district court by the Good News Clubs contending that their 1st and 14th Amendment rights were violated when Providence, RI school officials blocked approval of their use of school facilities for after-school programs. The complaint (full text) in Child Evangelism Fellowship of Rhode Island, Inc. v. Providence Public School District, (D RI, filed 3/10/2023) alleges in part:

CEF Rhode Island and its proposed Good News Clubs are similarly situated to the other organizations the District allows to host their afterschool programs in District elementary schools because all the organizations provide teaching and activities to develop things like confidence, character, leadership, and life skills in their participants. CEF Rhode Island, however, offers its programming from a Christian religious viewpoint, while the other organizations offer their similar programming from a nonreligious viewpoint....

The increasingly burdensome requirements the District has imposed on CEF Rhode Island as conditions to access for its Good News Clubs are discriminatory and pretextual disguises for the District’s hostility towards CEF Rhode Island’s Christian identity, message, and viewpoint.

Good News Club Claims Unequal Treatment By School District

A suit was filed in an Indiana federal district court yesterday against the Pike County, Indiana School District by the Good News Clubs alleging discriminatory treatment by the school district. The complaint (full text) in Child Evangelism Fellowship of Indiana, Inc. v. Indiana Metropolitan School District of Pike County, (SD IN, filed 5/8/2017), alleges that the school district charged Good News Clubs a fee for after-school use of elementary school facilities while waiving the fee for other community organizations. It also contends that Good News Clubs were denied the right to distribute literature through the schools while other community groups with whom the school partnered were permitted to do so. The suit asserts violations of the 1st and 14th Amendment. Liberty counsel issued a press release announcing the filing of the lawsuit.

In Settlement, Good News Clubs Win Equal Access To After-School Facilities

In Cleveland, Ohio, Child Evangelism Fellowship has won equal treatment with non-religious community groups in use of public school facilities for after-school activities.  The consent order (full text) in Child Evangelism Fellowship of Ohio, Inc. v. Cleveland Metropolitan School District, (ND OH, June 28, 2016) provides that the school district will revise its equal access policy for community use of district facilities.  Under the revised policy, the school district will accept the services provided to students by Good News Clubs as in-kind payment of fees for using facilities to the same extent as it accepts services of non-religious groups. The federal court consent order also provides that the school district will pay nominal damages of $100 and attorneys' fees of $149,900 because its prior unequal treatment of Child Evangelism Fellowship violated the 1st and 14th Amendments.
